The reported encampment is on City property, and recent federal court cases have restricted removal of homeless encampments on public property. In Martin v. City of Boise, the Ninth Circuit Court of Appeals issued a unanimous decision, finding that the City of Boise’s prohibition against sleeping in public violates the Eighth Amendment’s prohibition against cruel and unusual punishment when no alternative shelter is available. Thus, cities cannot enforce camping/lodging prohibitions if their local homeless population faces inadequate shelter space. However, the City will continue to monitor the location and assist with clean-ups when appropriate.

The City of Vallejo received $900K funds in 2022. The City of Vallejo Police Department (VPD)’s Integrated Health and Resource Team (IHART) will provide trauma-informed response and linkages to social services over arrest in Vallejo, California, through the VPD and its community partners. IHART will operate a 24/7/365 mobile crisis response that will serve the target area of the entire City of Vallejo and will be deployed by VPD dispatch. There is a homeless crisis in Vallejo that could use these resources.

Assist with clean ups as necessary?...not seeing that happening at all. And the Boise court decision does not preclude "moving" people camping or holding them accountable for damage to the environment.

It is unlawful for any person to deposit, dump, keep, accumulate, leave, or permit,
cause, or suffer any solid waste, bulky goods, recyclables or green waste to be
deposited, dumped, kept, accumulated, or left upon any lot or parcel of land, or on any
public or private place, street, lane, alley, lands under the jurisdiction of the California
State Land Commission, marsh or wetland, or body of water in the city, unless the
same is deposited, dumped, kept, or allowed to accumulate as provided in this
chapter.
